Undertakings

Once a person who has breached the Fair Trading Act or the regulations stops engaging in the unfair practice, the person may be required to enter into an "undertaking".

The purpose of an undertaking is to prevent future breaches of the Fair Trading Act or the regulations and may include any of the following specific undertakings:

  • Stop engaging in a practice or to change a practice described in the undertaking

  • Provide compensation to anyone who has suffered a loss

  • Publicize the undertaking or the action being taken

  • Pay the costs of investigating the person’s activities and any costs associated with the undertaking
