2001-02 FOIP Act Review

On November 28, 2001, the Legislative Assembly of Alberta appointed an all-party Select Special Committee to review the Freedom of Information and Protection of Privacy Act (FOIP Act), as required under section 97 of the Act.

Albertans were invited to participate in the review by submitting their comments to the Committee by May 10, 2002. The Committee considered all submissions and released its preliminary report on August 28, 2002. The Committee submitted its Final Report (PDF) in November 2002. The Report included twenty-six recommendations involving amendments to the FOIP Act.

The FOIP Amendment Act, 2003 received first reading in the Legislative Assembly on March 12, was passed on May 12, with house amendments, and received royal assent on May 16, 2003. The Act came into force on royal assent, with the exception of the amendment creating Division 1.1 of Part 5 (sections 74.1 to 74.91) and an amendment to section 8(2) of the Traffic Safety Act, both of which came into force on May 1, 2004.

FOIP Bulletin No. 14 (PDF), entitled FOIP Amendment Act, 2003, provides a comprehensive list of the amendments to the FOIP Act that received royal assent on May 16, 2003, and offers some guidance on interpreting the new and amended provisions. The bulletin also includes a brief account of several amendments to other Acts that appear as consequential amendments in the FOIP Amendment Act.
