Adjudicator Orders

Section 75 of the Freedom of Information and Protection of Privacy (FOIP) Act provides for the designation of an adjudicator in situations where the Information and Privacy Commissioner is not in a position to conduct a review because he or she has a conflict in relation to the subject matter of the review.

Adjudicators are designated by the Lieutenant Governor in Council and have the same powers and duties as the Commissioner. An Order made by an adjudicator is final (section 81(6)).

Note that the Commissioner may, under section 61 of the FOIP Act, delegate one of his portfolio officers to act as an adjudicator in his or her office. This officer may be delegated to conduct inquiries and issue Orders. The purpose of this delegation is to distribute the Commissioner's workload in areas of inquiries, not to deal with a specific issue of conflict of interest on the part of the Commissioner.  The name "adjudicator" that may be chosen for the delegate is simply an assigned title. It should not be confused with an adjudicator that has been designated by the Lieutenant Governor in Council for the purposes of section 75 of the FOIP Act.
